**WARSAW, October 31, 2026 —** A dispute over who can lead Poland’s Constitutional
Tribunal has escalated into a confrontation involving the president, the government
and police outside the court. Three protesters were detained following disturbances
near the building, while President Karol Nawrocki abandoned a trip to Senegal and
returned to Warsaw.

The immediate trigger was an announcement on Friday, October 30, that Judge Anna
Korwin-Piotrowska had suspended tribunal president Bogdan Święczkowski and deputy
president Bartłomiej Sochański from their duties, reportedly for one month. But
the legality of that step is itself disputed. Rival political and judicial figures
reject each other’s authority, making the crisis more complicated than a routine
change in court leadership. [Reuters reported the announcement and Nawrocki’s return](https://www.reuters.com/world/africa/polish-president-turns-back-senegal-trip-top-court-chief-suspended-2026-10-30/);

## What happened outside the tribunal?

Hundreds of demonstrators gathered near the Constitutional Tribunal in Warsaw on
Friday night and into Saturday. Opposition politicians joined the protests. Police
said three people were detained after objects were thrown toward officers and some
protesters attempted to breach a security barrier. Those reported actions should
not be attributed to every participant in the demonstrations.

Nawrocki, who is politically aligned with the opposition Law and Justice party (
PiS), cut short his journey to Senegal and visited the tribunal. On Saturday, he
described the leadership change as a threat to Poland’s constitutional order and
called for urgent consultations with parliamentary groups. These are the president’s
allegations and actions, _not_ a settled legal finding that a coup occurred.

## Why is the court’s leadership disputed?

Prime Minister Donald Tusk’s governing coalition says it is trying to restore judicial
independence after years of contested appointments and institutional changes under
PiS. Święczkowski, appointed to lead the tribunal during the earlier PiS era, has
been accused by Tusk’s side of preventing judges elected by the current parliamentary
majority from taking their seats.

Nawrocki and PiS figures counter that the latest suspension and attempted replacement
of the tribunal’s leadership are unlawful. The dispute also turns on the status
of judges selected by parliament but not sworn in by the president. [Germany’s Tagesschau described the competing institutional claims](https://www.tagesschau.de/ausland/europa/polen-verfassungsgericht-streit-100.html),
while [The Guardian reported disagreements among legal experts](https://www.theguardian.com/world/2026/oct/31/riot-police-deployed-to-polands-constitutional-court-after-judge-suspended).

## Why this matters beyond Warsaw

Poland’s constitutional court is supposed to resolve questions about the compatibility
of laws with the constitution. When the people claiming authority to run that court
are themselves in dispute, its ability to deliver decisions accepted across the
political spectrum can be weakened. That creates uncertainty for the executive,
parliament and ordinary people whose rights depend on reliable judicial review.

The standoff is also a test of Poland’s attempts to rebuild trust with European
institutions. The dispute traces back to contested judicial appointments beginning
in 2015, when European bodies criticized changes affecting judicial independence.
Neither side’s description of the current confrontation should be mistaken for a
final ruling on its legality.

## What to watch next

The key questions are whether the rival judicial leadership claims can be resolved
through a legally recognized procedure, whether the president’s consultations produce
a compromise, and whether the court can operate without further disruption. At this
reporting cutoff on October 31, no definitive resolution to the tribunal’s leadership
dispute had been independently confirmed.
